This Privacy Policy explains how Hyper Energy Bar ("Hyper," "we," "us," or "our") collects, uses, shares, and protects information when you visit hyperenergybar.com (the "Site") or interact with our digital services.

When you fill out a form, sign up for promotions, contact us, or otherwise communicate with us through the Site, we collect the information you provide, which may include your name, email address, phone number, ZIP code, and the contents of your message.

Information collected automatically.
When you use the Site, we and our service providers automatically collect certain information about your visit, including:

Loyalty Program information.
If you join the Hyper Rewards Loyalty Program, we collect additional information including your account credentials, transaction history at participating Hyper locations, rewards balance, redemption history, and preferences indicated within the program. We share necessary loyalty transaction data with the platform that operates our loyalty program on our behalf.

Employment and job application information.
If you apply for a position at Hyper through the Site, we collect the information you provide in your application, including your name, contact information, resume, work history, and any other information you choose to share. This information is used solely for evaluating your application and, if you are hired, for employment purposes. Employment and job applicant data is not used for marketing purposes. We collect the following categories of personal data:

  • Identifiers (name, email, phone, IP address, online identifiers, device IDs)
  • Commercial information (interactions with promotions, store location interest)

  • Transaction and purchase history (within the Loyalty Program)

  • Operate and administer the Hyper Rewards Loyalty Program, including tracking rewards, processing redemptions, and communicating program updates

Some U.S. state privacy laws define "sale" broadly to include disclosures of personal data for monetary or other valuable consideration, and define "sharing" or "targeted advertising" to include the use of personal data for cross-context behavioral advertising.

Under these definitions, our use of advertising technologies — including Meta Pixel, TikTok Pixel, and Google Ads tags — constitutes "sharing" of personal data for targeted advertising purposes under applicable U.S. state privacy laws. We do not exchange personal data for monetary payment.

You have the right to opt out of this activity at any time. See Section 9 below, or click the "Do Not Sell or Share My Personal Information" link in the Site footer.

8. Global Privacy Control and Browser Signals

We recognize the Global Privacy Control (GPC) browser signal. When a GPC signal is detected from your browser, we will treat it as a request to opt out of the sale or sharing of your personal data for targeted advertising for that browser and device.

9. Your Privacy Choices and Rights

Depending on your state of residence, you may have certain rights regarding your personal data, including the right to:

  • Access the personal data we have collected about you
  • Correct inaccurate personal data
  • Delete personal data we hold about you, subject to legal exceptions

  • Nebraska residents: within 45 days, with one possible extension of up to 45 additional days
  • Iowa residents: within 90 days, with one possible extension of up to 60 additional days
  • Other states: within the timeframe required by applicable law, or within 45 days if no specific timeframe applies

We will inform you of any extension and the reasons for it.

Verification.
To protect your information, we may need to verify your identity before responding to a request. We may ask you to confirm information we already have on file or to provide reasonable proof of identity.

Authorized agents.
You may designate an authorized agent to submit a request on your behalf. We may require written proof of authorization and verification of your identity.

10. Appeals

If we deny your privacy request in whole or in part, you may appeal that decision by emailing [email protected] with the subject line "Privacy Appeal." We will respond to your appeal within 60 days, explaining the result and the reasons for the decision. If your appeal is denied, you may contact your state Attorney General to file a complaint.

11. Data Retention

We retain personal data only as long as reasonably necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of data, the purpose for which it was collected, and applicable legal requirements.

12. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, and destruction. No online system, however, is completely secure, and we cannot guarantee the absolute security of information transmitted to or from the Site.

13. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
